Disgraceful act by police
Here is an incident about police officers who framed scientists in the Indian Space Research Organisation (ISRO) spy case. The presence of a Maldivian woman in India became the pretext for a police to perform this disgraceful act. They were arrested on the grave charge of sharing official secrets related to space technology and launch missions with foreign agents. The investigation shifted from the Kerala Police to the Central Bureau of Investigation after a few weeks. The CBI recommended closure of the case, citing complete lack of evidence and pointing to grave lapses in the police probe.
Now, one of those arrested, S. Nambi Narayanan, has been battling for the restoration of his honour and dignity. Compensation is a remedy for the violation of human rights. It should be ensured that all investigation into crimes and complaints remains lawful. While granting ₹50 lakh to Mr. Narayanan, the court has taken note of his wrongful imprisonment, malicious prosecution and humiliation. But justice is not only about relief and recompense, and should extend to action against those at fault too. Much of the blame must fall on the Kerala government.
When such police officers escape from the so called long hand of law after ruining a person's life and his dignity in society then it becomes an example for other brazen policeman to emulate. The justice will only be done if such people pay for their deeds and languish in jail even if they are retired. When a common man sees such case and the time it took for our system to restore the dignity of a person then his belief and confidence in judiciary and the whole system shakes and he will be reluctant to approach courts for remedies.
Narayanan gets the justice for his unrelenting struggle for the lost honor, mental cruelty and torture at the doors of the Apex court. But no amount of compensation can really recompense for what he had to suffer. The real justice will be brought only when the concerned police officials along with all other accomplice get in equivalence of what they rightly deserved for long. The concerned police officials should be taken to task in such a manner that this kind of heinous crime will not happen again and will form a guide for the future.
What should be basic function of judiciary in any democracy? One of those protecting the right of citizen. But the question here is that what about those cases when the right are violated by authoritarian organisation? Is judiciary empowered with the right to take action against authority?
We need to establish the coherent framework to alleviate the justice delay which is also another form of violation of human right. Exoneration of prisoner after a long walk is itself a injustice. Compensation can’t heal the plight completely. The effect is felt from moral, psychological, social, political, spiritual etc. angles which leads to disbelief, deficiency in the democracy system in the mind of common man.
After all nation is built by people not people by nation. If nation will fail to protect people, then the nation will collapse. We should think in that direction. It is a shame that a person who had been tirelessly working for the nation's programme was framed by the reckless police.
