Good law! But how to implement?
The restriction on the bursting of firecrackers cannot be implemented, police officials tasked with local level enforcement feel.
Ahead of Deepavali every year, the authorities are at pains to spread the message of safety and draw public attention to the ban on bursting of firecrackers between 10 p.m. and 6 a.m., in accordance with a judgment passed by the Supreme Court in 2005. Very few people bother to follow even these basic instructions. There were many instances of people bursting crackers on the streets or terrace of their houses beyond the stipulated time — 10 p.m or before 6 a.m. It was practically impossible to enforce the restriction in the previous years. How will the police implement the present restriction?
Last year, the police received several calls to the control room on the bursting of crackers beyond 10 p.m. When the patrol party reached such spots, the revellers had vanished. In most of the cases, children or youngsters were found bursting crackers, then how could they proceed against them and what provision of law could be invoked since they were bursting crackers for fun? There were also cases of false complaints by neighbours trying to settle scores. Police only booked cases against people in case the cracker bursting led to injuries or caused damage to property.
Normally during Deepavali, the strength of the police force is also lesser than on normal days. Nearly the entire city bursts crackers during the festival. How will they book everyone who violates time restrictions for celebrating with crackers? Sheer impossibility.
People should have elementary decency to obey civic laws. Earlier days it was only a lights festival. Sivakasi manufacturers also manufactured the idea that during diwali crackers should be burst. Originally in the festive season of Deepawali, the firecrackers' inflammation has increased. Firecrackers are extensively used in these particular occasion which is another way maximum offence due to have no restrictions bursting firecrackers openly in the public path. Firecrackers are mainly small explosive device from where maximum sudden accidental cases can happen. Supreme Court covered earlier in an exclusive report that the bursting firecrackers with a high level of volume should not be allowed for all time even in a particular zone that should be restricted of firing between 8 pm to 10 pm during the season of Deepavali or anything in the particular occasion. Firecrackers would be banned or stopped in the light of festive season that is so hard to restrict even accessing within a certain limit. Maximum revellers try to burst previously and stealthily before being recognised by the higher authority. It is really tough to control completely although it is happening in different places even sometimes brutally without caring some angry glances of the police force.
A total ban on the manufacture and sale of fire crackers etc is welcome. why it's so hard for the system to ban the manufacturing of fireworks in the first place if they really aim at curbing the pollution. As it's not the matter of one person cause but for the sake of humans and environment. Where people don't understand that this fun is on the price of lives of the people, being on the steering wheel it's a call for some strict actions that ought to be taken by the government.
All of us in this country know it well that such court orders or any law or rule for that matter are there to be honoured by a few law abiding citizens and not by a majority of people who hardly care for them. Disrespecting rules/court orders/ laws is so easy in this country.What happened to the ban on DJ and the ban on plastic..!!???
