Can
Mallya evade being sent to India?
British Home Secretary Sajid Javid has signed
the order for the extradition of liquor baron Vijay Mallya to India. Mally will
now have two weeks to lodge an appeal. Vijay Mallya is accused in India of conspiracy
to defraud, making false representations and money laundering offenses.
In making extradition decisions, the Minister
has to consider issues including whether the death penalty would be involved or
the person be extradited to a third country (neither of which would apply in
this case).
Anand Doobay, lawyer for Vijay Mallya, had
confirmed late last year that he intended to appeal the extradition order once
it was confirmed by the British authorities. Just days after the judgement in
December, Mr Doobay had said that he would “file an application for permission
to appeal.”
Should the appeal to the High Court fail,
Mallya would still have further opportunities to attempt to overturn the
extradition order, by seeking permission to appeal to the Supreme Court, though
that could only take place if the High Court certified that the appeal involved
a “point of law of general public importance, and either the High Court or the
Supreme Court gives leave for the appeal to be made.”
Late last week, Mr. Mallya took to Twitter to
criticise Indian authorities and the banks, accusing the latter of pursuing
“multiple frivolous litigations” against him. He accused the banks’ lawyers of
objecting to him paying “legitimate tax dues” in the U.K. Mallaya will leave no
leaf unturned to evade being sent to India.
So much money is spent by Indian government on
extradition. The question is how did BJP allow Vijay Mallya to escape from
India? Congress kept on restructuring his NPA which was a legal way of
corruption to get kickbacks from him. He was also given ticket of Rajya Sabha.
Then BJP gave him ticket again. Ultimately, it is the people of this country
paying for sins of Congress & BJP.
It is first time in annals of Indian history
that economic offender is being extradited to India. It reflects the integrity
of government. Even criminals are being brought to India. Thus criminals,
living in India, and fugitives are terrified of Modi government and joining
hands to dethrown the Modi.
‘Embrace the unexplored and be rewarded for the
exploration.’ The essence of this saying applies well to Modi government who
have fought tooth and nail and nailed Mallya in the end through this
extradition order from UK government which appeared to have slim chances until
recently.
Modi government has sent strong signals to
offenders through this prize catch that they can run but cannot hide and will
be zeroed in one day to be under captive in India. It is a victory through all
angles namely: Diplomatic, Legal, Judicial, Procedural, Compliance to name a
few.
Arthur Road Jail that was in the news for
housing the coziest room for Mallya is all set to receive him. Now
"intellectuals" will link it to 2019 elections and Gandhi will
somehow link it to Rafale scam.
