SC demands explanation from Indore High Court for granting bail to Bijlani
By Dinesh Kamath
NAVI MUMBAI: Supreme Court has asked the Indore High Court to explain as to how it could grant 60-day transit bail to Suresh Bijlani when SC had rejected his anticipatory bail application. Suresh Bijlani is wanted in connection with the Lahoria murder case and he has yet to surrender to the police.
Suresh Bijlani, while applying for bail at Indore Court, had suppressed the fact that his anticipatory bail application was rejected by the Supreme Court. This was pointed out by Sunny, son of the deceased Lahoriya. Bijlani’s lawyers, however, informed that they were unaware about this decision by Supreme Court.
The SC also asked Bijlani to either surrender to the police or present himself before the Thane sessions court immediately.
Earlier this month, Bijlani had filed a plea in the SC stating that his bail application be considered as his father was suffering from cancer. Bijlani, appeared before the Mumbai crime branch last month and handed over the Indore HC's 60-day transit bail order. However, Sunny informed the SC that Bijlani had suppressed the fact that the SC had rejected his bail plea and hence he was able to acquire 60-day interim relief order from Indore Court. SC then ordered the Mumbai police to immediately arrest Bijlani. Also, SC has now asked the Indore Court to explain for the order they issued.
The Bombay High Court had dismissed the anticipatory bail application of another accused in the case, architect Anuragh Garg. The HC told him to go to the lower court (Thane sessions court) and seek an anticipatory bail. The HC has also told Garg that he should be present before the court for the hearing of his anticipatory bail plea.
Another accused, Suryaprakash Agarwal, was also told by the HC to appear before it on June 19 when the matter of his interim relief will be heard.
Garg and Agarwal, who have been on the run for the last four months, may be arrested in the event the court rejects their bail, said a police source. Meanwhile, the city crime branch is on the lookout for another accused Suresh Bijlani.

Bijlani had filed a plea in the Supreme Court stating that his bail be considered as his father was suffering from cancer. The apex court after considering the petitions of Lahoria's son, Sandeep, and the Mumbai crime branch, posted this matter for hearing later this week. Bijlani has also been asked to be present in the court during the hearing of his plea.
